  • Use at your own risk: We provide the tool; you're responsible for how you use it.
  • Your data, your responsibility: Back it up. Export it. Don't lose it.
  • Analytics with a clear notice: We use Google Analytics for anonymous, aggregate site traffic only never your mood or journal data.
  • No warranty: It works well, but we can't guarantee perfection.
  • Open to change: We may update the app or these terms anytime.

1. Acceptance of Terms

By accessing or using Emotions Tracker (the "App"), you agree to be bound by these Terms & Conditions ("Terms"). If you disagree with any part, you may not use the App. Continued use after changes constitutes acceptance of updated Terms.

2. Description of Service

Emotions Tracker is a client-side web application for tracking moods, journaling emotions, and visualizing emotional patterns. Key characteristics:

  • Local-first: Runs entirely in your browser; no server-side processing of your data
  • No accounts: No registration, login, or identity verification required
  • Self-contained: All features work without external dependencies
  • Free: No payment required for any feature

3. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use the App for personal, non-commercial purposes
  • Store and process your own emotional data locally
  • Export your data in provided formats (JSON, Excel)

This license does not grant you rights to: copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the App's source code, design, or branding.

4. Your Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Not attempt to reverse engineer, decompile, or extract source code
  • Not use automated tools to scrape, stress-test, or abuse the App
  • Not inject malicious code or exploit vulnerabilities
  • Back up your data regularly (export via QR or Profiles page)
  • Understand that clearing browser data permanently deletes your App data

5. Your Data & Privacy

As detailed in our Privacy Policy:

  • We collect zero personal data from the app itself your mood entries, notes, and journal never leave your device
  • All your app data stays in your browser's local storage
  • We use Google Analytics for anonymous, aggregate site traffic only (such as page views and rough location) it never sees, collects, or stores your mood entries, notes, or journal data
  • We cannot access, recover, or reset your data
  • You are solely responsible for data backup and retention
  • Data loss due to browser updates, clearing cache, or device failure is your responsibility

6. Not Medical or Mental Health Advice

Important: Emotions Tracker is a self-reflection tool, not a medical device, diagnostic tool, or mental health treatment.

  • It does not provide medical advice, diagnosis, or treatment
  • It is not a substitute for professional mental health care

7. Disclaimers & No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT OF INTELLECTUAL PROPERTY
  • UNINTERRUPTED OR ERROR-FREE OPERATION
  • ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR FEATURES
  • COMPATIBILITY WITH ANY DEVICE, BROWSER, OR OPERATING SYSTEM

Some jurisdictions don't allow certain warranty exclusions, so the above may not fully apply to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • We shall not be liable for any loss of data, profits, goodwill, or use
  • Our total liability shall not exceed the amount you paid for the App (which is $0)

This limitation applies regardless of legal theory (contract, tort, negligence, strict liability, etc.) and even if we've been advised of the possibility of such damages.

10. Indemnification

You agree to defend, indemnify, and hold harmless Emotions Tracker and its creators from any claims, damages, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or violation of any rights of another.

11. Changes to the App

We may modify, suspend, or discontinue the App (or any feature) at any time without notice. We shall not be liable for any modification, price change, suspension, or discontinuance.

12. Changes to These Terms

We may update these Terms at any time. The "Last updated" date at the top indicates the latest revision. Material changes will be noted in the app. Continued use after changes constitutes acceptance.

13. Termination

You may stop using the App at any time. We may restrict access if you violate these Terms. Upon termination:

  • Your license to use the App ends immediately
  • Your local data remains in your browser (we cannot delete it)
  • Provisions that should survive (disclaimers, liability limits, indemnification) will survive

14. Governing Law

These Terms are governed by the laws of the jurisdiction where the App is operated, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of courts in that jurisdiction.

15. General Provisions

Severability
If any provision is unenforceable, the rest remain in effect.
Waiver
Failure to enforce a right doesn't waive it.
Entire Agreement
These Terms + Privacy Policy = entire agreement between us.
Assignment
You may not assign these Terms. We may assign them freely.
Force Majeure
We're not liable for delays due to events beyond our control.
